Privacy policy

This policy explains what personal data Digivolve collects, why we collect it, who we share it with, and the choices you have. We've written it to be read, and it applies to our website, our WhatsApp and email conversations, and the work we do for clients.

Who we are

Digivolve is a digital agency in Nigeria. We decide how and why your personal data is used when you deal with us, which makes us the data controller under the Nigeria Data Protection Act 2023.

If you have a question about this policy or your data, email hello@digivolveng.com or message us on +234 913 449 1990.

What we collect

We only collect what we need. That depends on how you deal with us:

  • When you use our contact form: your name, email address, and anything else you choose to give us, such as your business name, phone number, the services you need, your budget and details of your project.
  • When you message us on WhatsApp: your phone number, your WhatsApp name, and what you send us. For a free preview or free offer, that includes your business name and links, what you sell, your logo, photos or clips, and who your customers are.
  • When you email or call us: your contact details and what we discuss.
  • When you become a client: billing details, the materials you send us, and our records of the work. Card payments are handled by Paystack, so we never see or store your full card details.
  • When you visit our website: basic technical data such as your IP address, browser type and the pages you view. Our web host records this in server logs, and our advertising tag collects it as described below.

We may also look at information you've already made public, such as your Instagram page or Google listing, when you ask us to review it or use it for your preview.

Please don't send us sensitive information, such as health or financial records, unless it's needed for your project and we've agreed how to handle it.

How we use it, and our legal basis

We use your data for the purposes below. The law requires us to have a legal basis for each one, so we've listed it alongside.

  • To reply to your enquiry and prepare your preview or free offer: because you asked us to, and to take steps before a contract.
  • To deliver the work you've paid for, send invoices and support you: to perform our contract with you.
  • To keep tax, accounting and legal records: to meet our legal obligations.
  • To run, secure and improve our website, and to measure whether our advertising works: our legitimate interest in running our business, balanced against your rights.
  • To follow up with you about an offer you've asked about, or to send you marketing: our legitimate interest or your consent, depending on the message. You can opt out at any time.

We don't sell your personal data, and we don't make decisions about you using fully automated processes that have a legal or similarly significant effect on you.

Cookies and advertising

We use the Google Ads tag on our website. It uses cookies and similar technology to tell us when someone who clicked one of our ads goes on to open a WhatsApp chat with us about a free preview. That shows us which ads work. Google processes this data under its own terms and privacy policy.

If you open a video in our portfolio, it loads from YouTube or Instagram, and those services may set their own cookies and collect data about your viewing. They load only when you choose to play a video.

You can block or delete cookies in your browser settings, and control how Google personalises ads in your Google account's ad settings. Our website will still work if you do.

Who we share it with

We share data only with the people and services who help us run our business, and only as much as they need:

  • Meta, which runs WhatsApp, when you chat with us there.
  • Google, for advertising, measurement and business tools.
  • Paystack, to process payments.
  • Our website host and email provider.
  • The software and design tools we use to produce your work.
  • Domain registrars, when we register a domain in your name.
  • Professional advisers and authorities, when the law requires it or to protect our legal rights.

Transfers outside Nigeria

Some of these providers store or process data outside Nigeria. When that happens, we rely on the safeguards the law allows, such as the provider's data protection commitments or your consent.

How long we keep it

We keep data only for as long as we need it:

  • Private preview links stay live for 14 days, and then we archive them.
  • Enquiries that don't lead to work: up to 2 years after we last spoke.
  • Client records: for the length of our relationship, and for up to 6 years afterwards for tax and legal reasons.
  • Marketing contacts: until you opt out.

After that, we delete it or remove anything that identifies you.

How we protect it

We use reasonable technical and organisational measures to protect your data, including encrypted connections on our website and limiting access to the people who need it. No system is perfectly secure. If a breach is likely to put your rights at risk, we'll tell the Nigeria Data Protection Commission and you as the law requires.

Your rights

Under the Nigeria Data Protection Act, you have the right to:

  • Ask what data we hold about you and get a copy
  • Correct data that's wrong or incomplete
  • Ask us to delete your data
  • Ask us to restrict how we use it, or object to our use of it
  • Ask for your data in a portable format
  • Withdraw consent at any time, where we rely on it
  • Opt out of marketing whenever you like

To use any of these rights, email hello@digivolveng.com. We'll reply within 30 days. There's no charge, and we may need to confirm who you are first. Some requests may be limited where the law requires us to keep the data.

If you're unhappy with how we've handled your data, please tell us first so we can put it right. You can also complain to the Nigeria Data Protection Commission.

Children

Our services are for businesses and adults. We don't knowingly collect data from anyone under 18. If you think a child has given us their data, contact us and we'll delete it.

Changes to this policy

We'll update this page when our practices change, and the date at the top will show the latest version. If a change is significant, we'll let our clients know directly.
